What is a Short Sale Negotiation?
A Short Sale negotiation is one in which we get your lender to agree to take a loss on your loan when you sell your property for less than what you currently owe on your loan. Short sale negotiations are usually successful if you are dealing with a financial hardship that has made it impossible for you to pay your mortgage and you have tried to refinance your loan, tried to modify your loan, and tried to sell your property for the amount you currently owe but have been unsuccessful at all attempts.
Why Would My Lender Agree to Less Than What is Owed?
Due to the economic conditions and the mortgage crisis, your property may have lost its value making it impossible for you to sell it for what you currently owe to your lender. If trying to sell your property for what you owe on your mortgage loan means putting it on the market at a much higher listing price than other properties on the market, your property would sit on the market without any offers for a long time. If you are behind on your mortgage payments, this also means your lender will not get paid for a long time. If you were able to sell for a fair market price, even if it is less than what you owe your lender, it is more likely a buyer will come along. If you receive an offer, we can negotiate with your lender allowing you to sell your property and ridding yourself and your lender of the bad loan.
If your property were to not sell at auction after your lender already had to spend money on attorneys to foreclose against you in the first place, then they have to maintain the property the while it sits on the market, which is an expense that can add up pretty quickly. Banks aren’t in the real estate business, they’re in the lending money business and they most likely already have enough properties in their inventory from previous foreclosures that they don’t want to add yours to their list. Since a short sale is usually must faster and way less costly for your lender than it would be for them to hire an attorney to take your property through foreclosure, they are usually more willing to be paid less than the amount owed to get a non-performing loan off their books while at the same time collecting a lump sum of funds they can put back to use lending out to others.
Trust Our Short Sale Negotiation Attorneys
Your lender will analyze many factors before coming to any decisions in regards to your short sale, and these negotiations are performed on an individual basis. A short sale attorney with as much experience as the lawyers we bring to the table have the knowledge of predatory lending issues which may have been the reason which led to the need for a short sale in the first place as your loan may have been set up to fail. Through our negotiations, your mortgage lender will hopefully see your potential short sale as the “lesser loss” and we may be able to get them to accept a lesser amount than they are currently owed to avoid foreclosure and the time, fees, and costs associated with it as well as costs of sitting on a property that may not sell. One of our Short Sale Attorneys can help facilitate the process and look out for your best interests.

We offer all debt relief options and we service our clients like family. You should never settle for less when trying to settle for less!
Lower Fees
Since our clients don’t have tons of money to spare like attorneys that practice in other areas of law, we charge low fees making our services affordable for anyone that needs help. Unless your case involves one of our attorneys having to go to court, our negotiation service fees are flat fee based not charged hourly.
One on One Client Service
All of our client relationships are One on One. You’ll have one individual client service representative that will be your point of contact and you’ll build a relationship with them so they’ll know exactly what you are going through. Aside from treating you with the upmost care possible, this means you won’t have to deal with multiple people and re-explain your situation to a different person each time you call. This saves time for you and eliminates any extra stress for you as time is money and being stress free is just as important as being debt free!
Client Service Response Time
All of our attorneys, paralegals, and negotiators are dedicated to providing the best possible experience, while achieving results. We are available long hours but should we happen to be unavailable for any reason we pride ourselves on returning calls and emails right away, not several days later like most attorneys.
Our Reputation
Many companies do nothing for the high fees they charge. We have heard many horror stories. These companies aren’t proactive, they put no effort into negotiations, they don’t even return your calls let alone calls from collectors! These actions cause collectors to seek other measures to collect, often meaning lawsuits. We typically work repeatedly with the same companies and are known for resolving accounts so therefore have a great reputation with industry lenders and collectors. This benefits you when we contact these companies on your behalf, they know the accounts will get resolved and therefore we are usually able to avoid legal action!
Other Services
Many times, when we successfully arrange for a short sale, our clients still need assistance with other areas of their financial life. We offer many different services for those struggling with debts including Business Debt Relief, Consumer Debt Relief, Tax Relief, & Student Loan Relief. Frequently Asked Loan Modification Questions
Q: What is a Short Sale?
A Short Sale is a procedure in which we negotiate with your lender to sell your home for less than what you currently owe. All of this requires the approval of the lender. We will negotiate with your lender to allow for you to rid yourself of your problem mortgage loan.
Q: How much time do I have before they sell my home?
Every situation is different. The entire foreclosure process typically takes about three to six months depending on your location and other factors. The sooner we start the short sale process, and the more time we have to work with your lender, the greater the likelihood of success before they foreclose.
Q: Will I have to meet with my Bank/Lender?
No! We will take care of all the paperwork for you after you fill out your initial application. Once your application is complete, we will have all the necessary documents to negotiate and speak with your bank on your behalf.
Q: Is a Short Sale for me?
If you have tried to sell your home for what you currently owe on your mortgage loan and have been unsuccessful as the market prices in your area are lower than your sale price, a short sale may be an excellent option for you.
Q: Can anyone qualify for a Short Sale?
Unfortunately, not everyone will qualify for a short sale. Specific factors that determine whether or not you will qualify are your loan balance, the appraisal value of your property, your financial hardship, your income and assets, and numerous other factors. Our attorneys will ensure that your case is prepared correctly giving you the best chance at success.
Q: How long does the Short Sale Process take?
It depends. Fortunately, most lenders will take only a few months to approve a short sale once they have received the necessary information. It is typically a requirement that your property is listed for sale for at least 6 months to ensure as many potential offers as possible are entertained. Many lenders will postpone the sale of your property if they have received a complete package at least 37 days before the sale date.
Q: Can I negotiate a Short Sale by myself?
It is not a requirement that you hire an attorney to negotiate a short sale on your mortgage, however, many borrowers find that they get resistance from their mortgage lender and the process can be time-consuming and confusing. We have attorneys and real estate finance professionals on staff with decades of experience in dealing with mortgage lenders and financial transactions. Through our experience, we know what it takes to deal with different lenders and will do everything in our power to try to find a way for your Short Sale to be successful. We have the means and the infrastructure to work with lenders to help you reach your goal.
Q: Why should I use an attorney?
There are several reasons why you should use an attorney. Our attorneys have extensive experience negotiating with banks and legal entities and they understand the nuances of state laws, federal law, and lending regulations. An attorney can also threaten the recession of a loan, which would force the lender to return all unjustifiable fees. They can also use the Truth in Lending Act (TILA) and Real Estate and Settlement Procedures Act (RESPA) to the borrower’s advantage. Our attorneys will use these laws to put the servicers and lenders on the defense and help to negotiate a short sale of your loan.
