What is a Short Sale Negotiation?
A Short Sale negotiation is one in which we get your lender to agree to take a loss on your loan when you sell your property for less than what you currently owe on your loan. Short sale negotiations are usually successful if you are dealing with a financial hardship that has made it impossible for you to pay your mortgage and you have tried to refinance your loan, tried to modify your loan, and tried to sell your property for the amount you currently owe but have been unsuccessful at all attempts.
Why Would My Lender Agree to Less Than What is Owed?
Due to the economic conditions and the mortgage crisis, your property may have lost its value making it impossible for you to sell it for what you currently owe to your lender. If trying to sell your property for what you owe on your mortgage loan means putting it on the market at a much higher listing price than other properties on the market, your property would sit on the market without any offers for a long time. If you are behind on your mortgage payments, this also means your lender will not get paid for a long time. If you were able to sell for a fair market price, even if it is less than what you owe your lender, it is more likely a buyer will come along. If you receive an offer, we can negotiate with your lender allowing you to sell your property and ridding yourself and your lender of the bad loan.
If your property were to not sell at auction after your lender already had to spend money on attorneys to foreclose against you in the first place, then they have to maintain the property the while it sits on the market, which is an expense that can add up pretty quickly. Banks aren’t in the real estate business, they’re in the lending money business and they most likely already have enough properties in their inventory from previous foreclosures that they don’t want to add yours to their list. Since a short sale is usually must faster and way less costly for your lender than it would be for them to hire an attorney to take your property through foreclosure, they are usually more willing to be paid less than the amount owed to get a non-performing loan off their books while at the same time collecting a lump sum of funds they can put back to use lending out to others.

Failure to do so is a violation of the FDCPA, and we will sue them for you. There is no fee charged to you if we do not win your case, and if we do win, you can win up to $1,000 per violation, and the collector in violation will pay our attorney fees for you. Q: What is a Short Sale?
A Short Sale is a procedure in which we negotiate with your lender to sell your home for less than what you currently owe. All of this requires the approval of the lender. We will negotiate with your lender to allow for you to rid yourself of your problem mortgage loan.
Q: How much time do I have before they sell my home?
Every situation is different. The entire foreclosure process typically takes about three to six months depending on your location and other factors. The sooner we start the short sale process, and the more time we have to work with your lender, the greater the likelihood of success before they foreclose.
Q: Will I have to meet with my Bank/Lender?
No! We will take care of all the paperwork for you after you fill out your initial application. Once your application is complete, we will have all the necessary documents to negotiate and speak with your bank on your behalf.
Q: Is a Short Sale for me?
If you have tried to sell your home for what you currently owe on your mortgage loan and have been unsuccessful as the market prices in your area are lower than your sale price, a short sale may be an excellent option for you.
Q: Can anyone qualify for a Short Sale?
Unfortunately, not everyone will qualify for a short sale. Specific factors that determine whether or not you will qualify are your loan balance, the appraisal value of your property, your financial hardship, your income and assets, and numerous other factors. Q: How long does the Short Sale Process take?
It depends. Fortunately, most lenders will take only a few months to approve a short sale once they have received the necessary information. It is typically a requirement that your property is listed for sale for at least 6 months to ensure as many potential offers as possible are entertained. Many lenders will postpone the sale of your property if they have received a complete package at least 37 days before the sale date.
Q: Can I negotiate a Short Sale by myself?
